The “HITECH Act” - the Health Information Technology for Economic and Clinical Health Act, Title XIII of Division A and Title IV of Division B of the American Recovery and Reinvestment Act of 2009 (ARRA) – states that the Centers for Medicare & Medicaid Services (CMS) will initiate EHR “bonus” payments to physicians who can demonstrate they are “meaningful users” of a “certified” electronic health record.

DSI guarantees that MDsuite shall meet the certification requirements and meaningful use criteria as described by the Department of Health and Human Services in the HITECH Act and future clarifications of the HITECH Act as pertains to Ambulatory EHRs.  

Should DSI fail to do so, within five years of the Effective Date of our Agreement, you may terminate our Agreement and receive a credit of 12 months of Software Support fees if  you send us a written request for same and DSI fails to take such reasonable steps to correct such failure within thirty days from receipt of your written request.

This is not a guarantee of any payment under the HITECH Act.  Payment under the HITECH Act is also dependent on your “meaningful use” of MDsuite as proven to the Department of Health and Human Services.
